Many current social issues cannot be attributed directly to specific guarantees of human rights. Rather, they can only be perceived as a human rights problem by resorting to a creative interpretation of human rights provisions. The present course addresses this creative interpretation of human rights. At first, we will determine the principles applicable to the interpretation of public international law treaties and human rights treaties. Subsequently, we will examine the case law of international human rights bodies in order to discover how applicants and their representatives have creatively interpreted human rights guarantees and thus made them applicable to new social contexts and questions. Finally, we will analyze whether and how current social problems can be assigned by way of creative interpretation to a human rights provision. |
