| Inhalt |
Control over territory and the composition of the population belong to the last bastions of state sovereignty. Despite intensifying pressure for international solutions for a better “regulation” of international migration, conflicts of interests within states and between countries of origin of migrants and destination countries have hitherto precluded the establishment of an international migration regime. Despite the absence of a coherent encompassing regime, international migration today is shaped by a number of multilateral, (trans-)regional and bilateral treaties and institutions that together form a fragmented, multilayered system of migration governance. Drawing on cooperation theory (political science) and international law, this seminar examines these different layers of migration governance, differentiates between different aspects of migration policy (economic, human rights, development, security…) and the respective logics for cooperation, discusses the different degrees of legalization of existing frameworks (between soft and hard law) and analyses the interplay between bilateral, plurilateral and multilateral as well as soft- versus hard law settings for regulating international migration. |
