Inhalt The lecture offers an in-depth introduction to international investment protection law with a focus on investment arbitration under the ICSID-rules. Key issues will be the general protection of foreign investments in international law and the protection offered by bilateral investment treaties, especially under the ICSID-rules. The course will examine recent arbitration cases with regard to the protection of public goods, such as environmental policies and human rights and will offer a comparison between the so-called European and the U.S.-standard (esp. under NAFTA rules). Another issue will be the investment protection clauses in multilateral treaties (and negotiations), such as the Energy Charter Treaty and TTIP.

Lernziele To provide students with an understanding of the vulnerable position of foreign investors, the need for additional protection and the solutions offered by different treaty regimes; to promote practical skills in arbitration cases; to offer a deeper understanding of the role of investment arbitration in recent treaty negotiations with a view to a comparative law analysis.
