This class explores a special topic of United States Constitutional Law—Capital Punishment. The course will question whether the United States may ever justly impose the death penalty. In answering this question, we will examine the 8th Amendment of the U.S. Constitution, and the Supreme Court jurisprudence interpreting this amendment as it pertains to the death penalty, including constitutional limitations on the imposition of the death penalty. We will also explore the international human rights law pertaining to the death penalty and discuss how the international law impacts U.S. law and policy. In learning about the law of capital punishment, we will ask the following questions: Is the death penalty racist? Is the death penalty unfairly applied to those who are impoverished or otherwise disadvantaged? Can the death penalty ever promote justice? Can the death penalty be applied in a way that safeguards those who are innocent (for example, is the death penalty accurate)? |
