Data is produced and processed at unprecedented scales, speed and efficiency. Considering its emminent role for todays data-driven economy (e.g. training AI models), data has evolved into an asset class and key economic resource. This elective course is dedicated to how the European Union (EU) approaches data as an object of regulation and where EU law breaks new ground. When it comes to personal data, the EU takes a fundamental rights approach pursuant to the General Data Protection Regulation (GDPR). Based on the European Data Strategy two new legislative proposals have been adopted, i.e. the European Data Act and the Data Governance Act, which aim to promote a European data economy. Besides, numerous EU legislations now carry provisions on data sharing and through law and policy a range of sectoral data spaces are being constructed. This course will convey the legal architecture of European data law and its core concepts, such as data portability, data sharing and data governance. Taking this course will equip students with the essential knowledge to navigate and apply European data law. The course will combine lectures with active learning formats. |
